Federal inmates aged 65 or older can petition for compassionate release under specific criteria, even if they do not have a medical condition. These are called Elderly Inmate without Medical Condition Compassionate Release Petitions.
To qualify under the “Elderly Inmate without a Medical Condition” category, outlined in Bureau of Prisons Program Statement 5050.50, Compassionate Release/Reduction in Sentence, § 4(c), the inmate must be at least 65 years old and have served the greater of 10 years or 75 percent of their sentence. However, inmates who were 60 or older at the time of sentencing are generally excluded from this category.
Below is an example compassionate release petition for an inmate who meets the criteria. This example, based on a fictional elderly inmate with a fictional history, is designed to guide those seeking compassionate release. These petitions are often referred to as letters, applications, or forms.
If an inmate or their loved one is considering filing a compassionate release petition, it is highly recommended to seek a competent compassionate release lawyer. The Criminal Center has considerable experience researching, drafting, and filing compassionate release petitions for elderly inmates without medical conditions. Our team is here to provide support.

RE: Compassionate Release Petition for an Elderly Inmate without a Medical Condition
Dear Warden [Warden’s Name],
My name is Chris Williams, and I am currently incarcerated at FCI Marianna. I am writing to formally petition for compassionate release under Program Statement 5050.50, Compassionate Release/Reduction in Sentence: Procedures for Implementation of 18 U.S.C. § 3582(c)(1)(A).
This petition addresses explicitly the Elderly Inmate without a Medical Condition category, as outlined in Section 4(c) of the program statement. Inmates aged 65 or older who have served the greater of 10 years or 75 percent of their sentence qualify for compassionate release.
To provide context, I was sentenced on May 2, 2008, to 162 months of imprisonment for money laundering. I have served 120 months of my sentence and turned 67 in April.
During my incarceration, I have dedicated myself to personal rehabilitation. I’ve participated in numerous programs through the Psychology Department, including the Drug Education Class, Non-Residential Drug Abuse Program (NR-DAP), AA/NA, Smart Recovery, and several other classes. My commitment to these programs and my efforts to correct my thinking errors and distance myself from financial crime makes me a strong candidate for release. Additionally, I have maintained a spotless disciplinary record and have been employed as a librarian in the Education Department.
Although this compassionate release petition is primarily based on my age and time served, my commitment to rehabilitation makes me a strong candidate for release. I have adhered to Bureau of Prisons rules, engaged in treatment programs, and maintained regular contact with my family. I have used my time in prison to grow and reform.
Thank you for considering my request for Elderly Inmate without Medical Condition Compassionate Release. I understand the Bureau grants these requests sparingly, but I am a deserving candidate. The possibility of returning home would bring a significant positive change to my life, and I am hopeful for your favorable response.
Respectfully,
Chris Williams
