Elderly Inmate with Medical Condition Petition

Elderly inmates in Federal Bureau of Prisons custody who suffer from medical conditions can petition for compassionate release. The process of submitting an Elderly Inmate with Medical Condition Petition is crucial for those seeking release.

Program Statement 5050.50, Compassionate Release/Reduction in Sentence, Section 4(b), sets out the specific criteria for elderly inmates with medical conditions to be considered for compassionate release. To be eligible, an inmate must be 65 years or older, suffer from a chronic or serious medical condition related to aging, experience deteriorating mental or physical health that significantly diminishes their ability to function in a correctional facility, and have served at least 50 percent of their sentence. The Bureau of Prisons must also determine that treatment will not improve the inmate’s condition.

We provide a simplified petition example below to assist inmates and their families in seeking compassionate release under this category. This petition, also known as an Elderly Inmate with Medical Condition Petition, is based on a fictional person and condition. Although presented in letter format, such petitions are also known as compassionate release applications or forms.

RE: Compassionate Release Petition for an Elderly Inmate with a Medical Condition

Dear Warden,

My name is Samantha Scott, and I am incarcerated at USP Tucson Camp. I am submitting this Elderly Inmate with Medical Condition Petition for compassionate release under Program Statement 5050.50, Compassionate Release/Reduction in Sentence: Procedures for Implementation of 18 U.S.C. § 3582(c)(1)(A).

This petition specifically addresses the Elderly Inmate with a Medical Condition category outlined in Section 4(b) of the program statement. According to this policy, to qualify for compassionate release, an inmate must be 65 years or older, suffer from a chronic or serious medical condition related to aging, experience deteriorating mental or physical health that significantly diminishes their ability to function in prison, and have served at least 50 percent of their sentence.

On May 15, 2012, I was sentenced to 120 months in prison for insider trading. This year, I turned 65 and have served more than half of my sentence. Earlier this month, doctors at USP Tucson Camp diagnosed me with Alzheimer’s disease (see attached medical records). This condition is related to aging, is incurable, and progressively diminishes my ability to function. The rapid progression of my condition makes it urgent for me to seek compassionate release.

Due to my age and medical condition, I fear that if I complete my sentence, I will lose my mental faculties entirely. I sincerely wish to return home to spend time with my children and grandchildren before this disease takes over my mind. I understand the gravity of my actions and have paid a significant price for my crimes. While incarcerated, I have participated in Victim Impact and Criminal Thinking classes and other programs in the Psychology Department. I have maintained clear conduct throughout my sentence. I am confident that I will never re-offend and am committed to living a law-abiding life if granted compassionate release.

If granted compassionate release, I will live with my husband, Roger Scott, at 456 River Road, Anytown, GA 00000. I will support myself using my savings and financial assistance from my husband. I also plan to secure health insurance to cover my medical needs.

I respectfully request that you consider my Elderly Inmate with Medical Condition Petition and allow me to spend my remaining time with my family while I can still function. I no longer pose a threat to society and sincerely wish to be with my loved ones during this time. The thought of being with my family is the only thing that keeps me going in these difficult times.

Respectfully Submitted,
Samantha Scott
